This lawsuit involves a lesbian couple with a Canadian marriage license challenging the Florida and federal DOMAs. The federal government has not yet responded to the complaint.

Sullivan v. Bush, Case No. 04-21118-CV

Several same-sex couples have filed this suit challenging the constitutionality of the federal and Florida DOMAs. The Department of Justice has filed a motion to dismiss for lack of standing—the plaintiffs are not validly married under the laws of any states, so federal DOMA has not harmed them.

Wilson v. Ake, No. 8:04-CV-1680-T-30 TBM

A lesbian couple with a Massachusetts marriage license filed this action challenging the Florida and federal DOMAs. The marriage license is invalid under Massachusetts law. The federal government has not yet filed its motion to dismiss.

In re Allen, 186 B.R 769 (Bankr. Ct., N.D. Ga. 1995)

A same-sex couple filed a joint petition in bankruptcy. The judge dismissed the petition because the debtors were not legally married.
